KMI Panel rules Arsenal ‘should have had penalty’ in Everton win

The Premier League’s Key Match Incidents (KMI) Panel has unanimously ruled that Arsenal should have been awarded a penalty during their 2-0 victory over Everton at the Emirates Stadium on 14 March.
The incident occurred in the 24th minute when Kai Havertz went down under a challenge from Michael Keane inside the Everton penalty area. Referee Andy Madley waved play on, with VAR official Stuart Attwell deciding the contact was “minimal”.

However, all five members of the independent KMI Panel felt Madley should have pointed to the spot after reviewing the incident. Replays showed that the Everton defender had inadvertently stepped on Havertz’s foot, creating enough contact to warrant a penalty.
VAR Decision Splits Panel
While the panel was unanimous that a penalty should have been given on-field, they were split 3-2 on whether VAR was correct not to intervene. According to the BBC, three panel members supported Attwell’s decision not to recommend a review, while two felt VAR should have intervened.
This creates an interesting situation where the original decision was deemed incorrect, but the VAR process was largely supported for not overturning what was considered a subjective call.
The ruling highlights the ongoing complexities around VAR implementation in the Premier League, particularly regarding what constitutes “clear and obvious error” – the threshold required for VAR intervention.
Arsenal’s VAR Record This Season
The panel’s findings reveal that Arsenal have had no VAR errors recorded against them this season, suggesting the video technology has generally worked in the Gunners’ favour or remained neutral.
However, two missed spot-kicks for the opposition have been logged in Arsenal’s favour during away fixtures against Everton and Brighton. This indicates that while Arsenal may have been denied this particular penalty, they have benefited from similar oversights in other matches.
The Germany international’s penalty appeal ultimately had no bearing on the match result, as Arsenal secured a comfortable 2-0 victory to maintain their strong position in the Premier League standings. The panel’s retrospective analysis serves more as a reference point for future officiating standards rather than having any practical impact on the result.
